1. Platform Definition

Abraj Stay is an electronic platform that allows users to:

• Browse hotels and accommodation facilities
• Make accommodation bookings
• Benefit from additional services such as requesting taxis

The platform acts as a technical intermediary between the user and service providers (hotels and service providers).

2. Acceptance of Terms

By using the site or application, you acknowledge your agreement to these Terms and Conditions and Privacy Policy. If you do not agree to any clause, you must immediately stop using the platform.

3. Amendments to Terms

Abraj Stay reserves the right to modify or update these terms at any time. Amendments become effective immediately upon being posted on the site or application. Your continued use of the platform after the update constitutes an implicit acceptance of the modifications.

4. Registration Conditions

To benefit from Abraj Stay services, you must:

• Be at least 18 years old
• Provide correct and accurate data, including: Name, Phone number, Email, Geographical location
• The account is personal and non-transferable. The user is fully responsible for maintaining the confidentiality of their login data and password.

5. Booking Policy

• The full booking value is paid via available payment methods within the platform or payment upon arrival حسب سياسة الحجز.
• Acceptance of the booking is subject to confirmation by the service provider (hotel).
• The user is notified of booking confirmation or rejection during official working hours.

6. Cancellation and Refund (Compatible with Sadad)

Abraj Stay is committed to providing a flexible return policy that ensures the user's rights according to the following controls:

First: Return Options

• Refund to electronic wallet: The amount is deposited as credit in the application wallet for use in subsequent bookings. This option is characterized by speed of execution and a validity of up to 6 months.
• Cash refund (Bank account): The customer has the right to request a refund to their bank account or the card used for payment, only if the booking policy (at purchase) states "Refundable".

Second: Cash Refund Controls

Administrative fees: When choosing a cash refund, bank transfer fees or electronic payment gateway fees may be deducted from the total refunded amount. Time duration: The process of returning funds to the bank account takes between 7 to 14 working days, depending on the policy of the card-issuing bank. Non-refundable bookings: If the booking is confirmed under the "Non-refundable" classification, the user is not entitled to claim the amount in cash or via the wallet in case of cancellation.

Third: Cancellation by the Platform or Hotel

If the booking is cancelled by the hotel or due to a technical glitch in the platform, the user is entitled to a full cash refund without deducting any administrative fees.

Fourth: Violation of Policies

The booking is cancelled and no refund is entitled in case of entering incorrect data or violating hotel policy (such as age conditions, smoking, or general behavior), and the amount is then subject to the "Early Hotel Departure" policy.

7. Prices and Payment (Sadad Requirements)

• All displayed prices include taxes and statutory fees.
• The approved currency is the US Dollar (USD). Payment operations are carried out via approved payment gateways (such as Sadad or others).
• Abraj Stay does not retain bank card data or payment methods. Verification of payment operations is the responsibility of the used payment gateway.

8. Privacy Policy and Data Protection

Abraj Stay is committed to protecting user data according to the regulations of the Kingdom of Saudi Arabia.

9. Intellectual Property

All contents, trademarks, logos, and texts in Abraj Stay are owned by the platform. It is prohibited to copy or reuse any content for commercial purposes without prior written consent.

10. User Content

The user has the right to add ratings and comments provided they adhere to public ethics and do not violate regulations. Abraj Stay reserves the right to delete or modify any content without prior notice.

11. Limitation of Liability

Abraj Stay does not guarantee that the service will be free from technical failures or interruptions. The platform bears no responsibility for any losses resulting from: Force majeure, failures outside the scope of control, or errors from service providers.

12. Law and Jurisdiction

These Terms and Conditions are governed by the laws and regulations of the Kingdom of Saudi Arabia, and the judicial jurisdiction shall be for the competent authorities within the Kingdom.
